IMPORTANT NOTICE: INTERMEDIARY PLATFORM
Live Bazar operates as an intermediary e-commerce platform under the Consumer Protection (E-Commerce) Rules, 2020 and Information Technology Act, 2000. We connect independent sellers with buyers but do not own, manufacture, or directly sell any products. Sellers are independent third parties responsible for their products, pricing, and policies.
By using Live Bazar, you agree to these Terms of Service.

1. DEFINITIONS
1.1 "Platform" refers to website livebazar.in, mobile applications, and all related services operated by Live Bazar.
1.2 "Seller" refers to independent third-party vendors who list and sell products on the Platform.
1.3 "User/Buyer" refers to persons who access or use the Platform to browse or purchase products.
1.4 "We/Us/Our" refers to Live Bazar, the intermediary platform operator.
1.5 "Services" refers to platform services including listing, transaction facilitation, payment processing, and logistics coordination.

2. ACCEPTANCE OF TERMS
2.1 Binding Agreement
By accessing or using Live Bazar, you agree to be bound by:
- These Terms of Service
- Privacy Policy
- Return and Refund Policy
- Shipping Policy
- All applicable laws of India
2.2 Eligibility
You confirm that:
- You are at least 18 years old or have parental/guardian consent
- You have legal capacity to enter into binding contracts under Indian Contract Act, 1872
- All information provided is accurate and complete
- You will use the Platform in compliance with all applicable laws
2.3 Right to Refuse Service
We reserve the right to refuse service, terminate accounts, or cancel orders at our discretion, particularly if we suspect fraudulent activity or violation of these Terms.

3. PLATFORM ROLE AND LIMITATIONS
3.1 Intermediary Status
Live Bazar operates as an "intermediary" as defined under Section 79 of Information Technology Act, 2000 and Rule 3 of Consumer Protection (E-Commerce) Rules, 2020.
As an intermediary, we:
- Provide a platform for sellers to list products
- Facilitate transactions between buyers and sellers
- Process payments and remit to sellers
- Coordinate logistics where applicable
- Provide customer support services
We DO NOT:
- Own, manufacture, or directly sell products
- Control product quality, pricing, or availability
- Determine seller policies (returns, refunds, exchanges)
- Guarantee seller performance or product authenticity
- Act as agent or representative of sellers
3.2 Limited Liability as Intermediary
As per Section 79, Information Technology Act, 2000, Live Bazar shall not be liable for any third-party information, data, or communication made available or hosted on the Platform.
We are not responsible for:
- Product quality, safety, legality, or authenticity
- Seller representations, warranties, or guarantees
- Seller compliance with applicable laws
- Disputes between buyers and sellers
- Losses arising from seller actions or inactions
- Content posted by sellers or users
3.3 Safe Harbor Protection
Live Bazar qualifies for safe harbor protection under IT Act as we:
- Do not initiate, select, or modify content
- Act solely as intermediary
- Remove unlawful content upon notice
- Comply with due diligence requirements

4. SELLER RELATIONSHIP
4.1 Independent Contractors
Sellers are independent third parties, not employees, agents, or representatives of Live Bazar.
4.2 Seller Responsibilities
Each seller is solely responsible for:
- Product authenticity, quality, and safety
- Accurate product descriptions and pricing
- Compliance with applicable laws (GST, legal metrology, BIS, etc.)
- Return, refund, and warranty policies
- Fulfillment and delivery
- Customer service for their products
- Legal liability for their products
4.3 No Endorsement
Listing of products on Platform does not constitute endorsement by Live Bazar. We make no representations about seller reliability or product suitability.

5. USER ACCOUNTS
5.1 Account Creation
- Accurate information required
- One account per person/entity
- You are responsible for account security
- Notify us immediately of unauthorized access
5.2 Account Termination
We may suspend or terminate accounts for:
- Violation of these Terms
- Fraudulent or illegal activity
- Non-payment
- Abuse of Platform or other users
- Any reason at our discretion

6. ORDERS AND TRANSACTIONS
6.1 Order Placement
- Orders are offers to purchase from sellers
- Orders subject to seller acceptance
- We facilitate order transmission to sellers
- Sellers may accept or reject orders
6.2 Contract Formation
Contract is between buyer and seller, not with Live Bazar. Contract is formed when:
- Seller accepts the order
- Confirmation is sent to buyer
- Live Bazar acts only as facilitator
6.3 Payment Processing
- Payment collected by Live Bazar on behalf of sellers
- We act as payment collection agent
- Funds held in trust and remitted to sellers
- Platform fee deducted before remittance
- GST applicable as per law
6.4 Pricing
- Sellers determine all prices
- Prices include GST unless stated otherwise
- Prices subject to change by sellers
- We are not responsible for pricing errors by sellers

7. PRODUCT INFORMATION
7.1 Seller-Provided Information
All product descriptions, images, specifications, and claims are provided by sellers. Live Bazar:
- Does not verify accuracy
- Makes no warranties about accuracy
- Is not liable for misrepresentations by sellers
7.2 User Responsibility
Users should:
- Verify product details with sellers
- Check seller ratings and reviews
- Ask questions before purchasing
- Understand seller's return policy

8. USER CONDUCT
8.1 Prohibited Activities
You shall not:
- Violate any Indian laws or regulations
- Infringe intellectual property rights
- Post false, misleading, or defamatory content
- Harass or threaten other users or sellers
- Engage in fraudulent transactions
- Use automated systems to scrape or copy content
- Reverse engineer or hack the Platform
- Sell prohibited items (weapons, drugs, counterfeit goods)
- Manipulate reviews or ratings
8.2 Consequences
Violation may result in:
- Account suspension or termination
- Legal action under applicable laws
- Liability for damages

9. INTELLECTUAL PROPERTY
9.1 Platform Content
All content on Platform (logos, trademarks, text, graphics, software) is owned by Live Bazar or licensors and protected under:
- Copyright Act, 1957
- Trademarks Act, 1999
- Information Technology Act, 2000
Unauthorized use is prohibited.
9.2 User Content
By posting content (reviews, photos, comments), you:
- Grant Live Bazar non-exclusive license to use, display, and distribute
- Warrant you have rights to the content
- Agree content does not violate any rights or laws
9.3 Seller Content
Product listings, images, descriptions are owned by sellers. Live Bazar has license to display for Platform operation only.

10. DISCLAIMERS AND WARRANTIES
10.1 Platform "As Is"
Platform provided "as is" without warranties of any kind, express or implied, including:
- Merchantability
- Fitness for particular purpose
- Non-infringement
- Uninterrupted or error-free operation
10.2 No Product Warranties
Live Bazar makes no warranties regarding:
- Product quality, safety, or legality
- Product descriptions or representations
- Seller performance or reliability
- Delivery timelines
- Product availability
Any warranties are provided by sellers directly, not by Live Bazar.
10.3 India-Specific Disclaimer
Nothing in these Terms excludes rights under Consumer Protection Act, 2019 that cannot be excluded by law.

11. LIMITATION OF LIABILITY
11.1 Maximum Liability
To the maximum extent permitted under Indian law, Live Bazar's total liability for any claim shall not exceed the platform fees paid by you in the transaction giving rise to the claim.
11.2 Excluded Damages
Live Bazar is not liable for:
- Indirect, incidental, consequential, or punitive damages
- Loss of profits, revenue, or business
- Loss of data or goodwill
- Product defects, injuries, or damages caused by products
- Seller misconduct or non-performance
- Delivery delays beyond our control
- Force majeure events
11.3 Basis of Intermediary Status
These limitations are fundamental to our role as intermediary platform and are enforceable under Section 79, IT Act, 2000.

12. INDEMNIFICATION
You agree to indemnify and hold Live Bazar, its officers, directors, employees harmless from:
- Your violation of these Terms
- Your violation of any laws or regulations
- Your violation of rights of third parties
- Content you post on Platform
- Your use of Platform services
- Claims by sellers related to your conduct

13. DISPUTE RESOLUTION
13.1 Buyer-Seller Disputes
Disputes regarding products, delivery, or seller performance:
- Are between buyer and seller directly
- Seller is the proper party for complaints
- Live Bazar may facilitate resolution but is not obligated to
- Live Bazar is not liable for resolution outcomes

13.3 Arbitration
Disputes with Live Bazar (not sellers) shall be resolved through:
- Good faith negotiation first
- If unresolved, arbitration under Arbitration and Conciliation Act, 1996
- Single arbitrator appointed by mutual consent
- Seat of arbitration: Bangalore, Karnataka
- Language: English
- Arbitration award binding and enforceable
13.4 Consumer Rights
Nothing in these Terms affects consumer rights under:
- Consumer Protection Act, 2019
- Right to approach Consumer Forums
- Rights under Sale of Goods Act, 1930

14. GOVERNING LAW AND JURISDICTION
14.1 Applicable Law
These Terms governed by laws of India, including:
- Information Technology Act, 2000
- Consumer Protection Act, 2019
- Consumer Protection (E-Commerce) Rules, 2020
- Indian Contract Act, 1872
- Sale of Goods Act, 1930
14.2 Jurisdiction
Exclusive jurisdiction: Courts of Bangalore, Karnataka, India

15. MODIFICATIONS
We may modify these Terms at any time. Changes effective upon posting. Continued use constitutes acceptance. Material changes will be notified via email or Platform notice.

16. SEVERABILITY
If any provision is held invalid or unenforceable, remaining provisions continue in full force.
